POPIA Information Notice

Protection of Personal Information Act, 4 of 2013

This notice is provided in terms of Section 18 of the Protection of Personal Information Act 4 of 2013 ("POPIA"). As a responsible party, MINC Financial Services is required to notify you of the purpose and intended use of your personal information at the point of collection.

  • Financial information: Employment details, net salary, banking details, bank statements
  • Credit information: Credit history and bureau reports (with your consent, as required by the NCA)
  • Supporting documents: ID copy, payslip, proof of employment
  • Communication records: Correspondence, complaints, and enquiries

3. Why We Collect Your Personal Information

Your personal information is collected for the following specific purposes:

  • To process and assess your loan or funeral cover application
  • To verify your identity and prevent fraud and money laundering (FICA compliance)
  • To conduct credit checks and affordability assessments as required by the National Credit Act
  • To process funeral cover policy applications and manage policy administration
  • To communicate with you regarding your application, policy, or account
  • To comply with our legal and regulatory obligations to the NCR, FSCA, and SARS
  • To resolve complaints and provide customer support
  • To improve our products and services through aggregated analytics

4. Lawful Basis for Processing

We process your personal information on the following lawful grounds:

  • Consent (Section 11(1)(a)): You provide explicit consent on our application forms for specific processing activities, including credit bureau checks
  • Contractual necessity (Section 11(1)(c)): Processing is necessary to enter into or perform a financial services agreement with you
  • Legal obligation (Section 11(1)(c)): Processing required to comply with the NCA, FSCA regulations, FICA, and POPIA itself
  • Legitimate interests (Section 11(1)(f)): Fraud prevention, security, and business improvement activities that do not prejudice your rights

5. Who We May Share Your Information With

In the course of providing our services, we may share your personal information with the following third parties who are bound by confidentiality obligations and data processing agreements:

  • Credit Bureaus: TransUnion, Experian, Compuscan, or XDS — for credit checks (with your explicit consent)
  • Structured Risk Solutions (FSP 50618): Funeral cover underwriter — for policy assessment and administration
  • Structured Administration Services: Our FSP licensor — as required for compliance and reporting
  • Technology service providers: Cloud infrastructure, email delivery, and analytics providers under strict data processing agreements
  • Regulatory authorities: The NCR, FSCA, SARS, and other authorities as required by law
  • Law enforcement: Where required by a court order or statutory obligation

We will never sell your personal information to third parties for marketing purposes.

6. Your Rights Under POPIA

As a data subject under POPIA, you have the following rights:

Right to be notified

You have the right to be informed when your personal information is collected — which this notice fulfils.

Right to access

You may request access to the personal information we hold about you (Form 1 of the Regulations to POPIA).

Right to correction

You may request that inaccurate, irrelevant, or outdated personal information be corrected or deleted.

Right to deletion

You may request deletion of your personal information, subject to our legal retention obligations.

Right to object

You may object to the processing of your personal information for direct marketing purposes.

Right to complain

You may lodge a complaint with the Information Regulator of South Africa if you believe your rights have been infringed.

We will respond to your request within 30 business days as required by POPIA. We may require proof of identity before processing your request.
